1. Agreement to These Terms
These Terms of Service (the “Terms”) are a binding legal agreement between you and ZykoStudy (“ZykoStudy,” “we,” “us,” or “our”) governing your access to and use of the ZykoStudy website, games, and related features and services (together, the “Service”).
By creating an account, clicking to accept these Terms, or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not access or use the Service.
If you are using the Service on behalf of a school, district, or organization (for example, a teacher setting up classes), you represent that you are authorized to accept these Terms on its behalf, and “you” refers to that party as well. If your school or district has a separate written agreement with ZykoStudy (such as a data privacy agreement), that agreement controls over these Terms to the extent of any conflict, for use covered by that agreement.
You consent to receive agreements, notices, disclosures, and other communications from us electronically, and you agree that electronic communications satisfy any legal requirement that a communication be in writing. We will deliver legally required and material notices by email to the address on your account (other communications may be posted on the Service). You may request a paper copy of any legally required disclosure, or withdraw your consent to electronic delivery, by contacting support@zykostudy.com; withdrawing consent may mean you can no longer use the Service. To receive electronic communications you need a device with a supported web browser and an active email account; keep your email address up to date in your profile settings.
2. Who May Use ZykoStudy (Eligibility & Age)
The Service is an educational product intended for students, teachers, and parents/guardians. You may only use the Service if you can form a binding contract with ZykoStudy (or your parent, guardian, or school accepts these Terms on your behalf) and you are not barred from using the Service under applicable law.
Minimum age
You must be at least 13 years old to create your own ZykoStudy account. We ask for your date of birth during student sign-up to screen eligibility, and we do not permit self-registration by anyone under 13.
Supervised accounts for children under 13
A parent or legal guardian who is at least 18 years old may create a supervised account for their child under 13 from their own account (Profile → Family) after providing verifiable parental consent as described in our Privacy Policy. By creating a supervised account you represent that you are the child’s parent or legal guardian, you accept these Terms on the child’s behalf, and you are responsible for the account and its activity. Supervised accounts cannot use direct messages, class chat, or live races, do not appear on leaderboards, and have AI features turned off unless the parent enables them with a separate consent. The parent can review the child’s information, reset the password, and withdraw consent at any time from the Family dashboard; withdrawing consent deletes the account and its personal information as described in the Privacy Policy.
If you are between 13 and the age of majority in your place of residence, you may use the Service only with the involvement and consent of a parent, legal guardian, or your school. By using the Service, you represent that a parent, legal guardian, or your school knows about and consents to your use, and parents, guardians, and schools remain responsible for the use they permit. We do not currently collect that consent directly at sign-up.
Parents, guardians, and schools are responsible for supervising the minors in their care, for the accounts they enable, and for all activity that occurs under those accounts. If we learn that an account belongs to a child under 13 outside a supervised account, we will terminate the account and delete its personal information as described in our Privacy Policy.
3. Accounts & Account Security
To use most features you must create an account using an email address and password or by signing in with a supported third-party provider (such as Google). You agree to provide accurate, current, and complete information and to keep it up to date.
- You are responsible for safeguarding your login credentials and for all activity that occurs under your account.
- Do not share your account, let others use it, or use another person’s account without permission.
- Each person may maintain only one account unless we expressly permit otherwise.
- Notify us promptly at support@zykostudy.com if you suspect any unauthorized access to or use of your account.
We may take reasonable measures to protect accounts, including rate-limiting sign-in attempts, temporarily locking accounts after repeated failed logins, and logging security-relevant events. We are not liable for any loss arising from unauthorized use of your account that results from your failure to keep your credentials secure.
4. User Roles & Teacher Verification
The Service supports different roles, including students, teachers, and administrators. The features available to you depend on your role.
- Students can play learning games, join classes using a class code, complete assignments, track progress, and (where enabled) participate in class messaging.
- Teachers can create and manage classes, create or upload question sets, assign work, view their students’ progress and submissions, correct a student’s name (which updates the name on the student’s account), and manage class messaging settings.
- Teachers may transfer ownership of a class to another verified teacher at the same school; the receiving teacher gains access to that class’s roster, messages, progress, and submissions.
- Teacher tools require a valid school or institutional email and may be subject to email verification and review or approval before they unlock.
You agree not to misrepresent your role, identity, age, school affiliation, or eligibility. Misrepresentation (including registering as a teacher when you are not one) may result in suspension or termination of your account.
5. License to Use the Service
Subject to your compliance with these Terms, ZykoStudy grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own educational and instructional purposes. We may update, change, or discontinue features of the Service at any time.
6. Paid Plans & Billing
The core Service is free to use. We also offer paid subscription plans: “Plus” at US$7.99 per month and “Premium” at US$10.99 per month, each billed monthly in advance until cancelled. All prices are in U.S. dollars and are the total amount charged — we do not add tax at checkout, though your bank or card issuer may apply its own currency-conversion or foreign-transaction fees. The included features of each plan, and any promotional price, are shown on our pricing page and again at checkout. Payments are processed by Stripe — we never see or store your full card details.
When you purchase a subscription, the following terms apply, together with the specific price, billing period, and renewal terms presented at checkout:
- Subscriptions renew automatically at the end of each billing period (for example, monthly) and your payment method is charged at the then-current rate until you cancel. The renewal price and cadence are disclosed, and your express consent to them is collected, at checkout before you are charged.
- If you redeem a promotional code, the discount applies only for the period stated with the offer. When that period ends, your subscription renews at the standard monthly rate for your plan — US$7.99 for Plus, US$10.99 for Premium — starting with your next renewal.
- You can cancel online at any time — at least as easily as you signed up — from your profile’s Billing tab (“Manage subscription”). Cancellation takes effect at the end of the current billing period, and you keep your plan’s features until then.
- Except where a refund is required by applicable law, payments are non-refundable: cancelling stops future renewals but does not refund the current billing period, in whole or in part. Nothing in these Terms limits refund or cancellation rights you have under applicable law.
- We will give you advance notice before increasing the price of an active subscription, and the increase will apply no earlier than your next renewal after notice.
- You must be old enough to form a binding contract to purchase. If you are under the age of majority where you live, you may purchase a paid plan only with the consent of a parent or legal guardian — by purchasing, you represent that a parent or legal guardian has authorized the purchase and accepts responsibility for it, and a parent or legal guardian may contact support@zykostudy.com to cancel a minor’s subscription.
- Paid-plan entitlements (such as plan features and game access included with a plan) are not “Virtual Items” under the section below: we will not revoke them without a refund of the unused portion, except for violations of these Terms, and the Virtual Items forfeiture rules do not apply to anything you purchased for money.
If a payment fails at renewal, paid features stop right away and your account continues on the free plan while Stripe retries the payment; the unpaid invoice remains due. If a retry succeeds, your paid features come back automatically. While a payment is outstanding you can still update your payment method or cancel from your profile’s Billing tab, and if the subscription is ultimately cancelled for non-payment you can subscribe again at any time. Cancelling a subscription never deletes your account or your study data.
7. Acceptable Use & Prohibited Conduct
You agree to use the Service only for lawful, educational purposes and in compliance with these Terms and all applicable laws and school policies. You must not:
- Upload, post, generate, or share content that is illegal, infringing, harmful, harassing, threatening, abusive, hateful, sexually explicit, violent, defamatory, or otherwise objectionable;
- Harass, bully, threaten, impersonate, or harm other users, including through class chat or direct messages;
- Use the Service to cheat on, or gain unfair advantage in, any actual exam, standardized test, or graded assessment, or to violate your school’s academic-integrity rules;
- Attempt to access accounts, data, or areas of the Service you are not authorized to access, or probe, scan, or test the vulnerability of the Service or breach its security or authentication measures;
- Use bots, scrapers, or other automated means to access, copy, or interact with the Service, or scrape, harvest, or collect information about other users;
- Cheat, manipulate, or falsify game scores, XP, leaderboards, streaks, assignments, or progress data, or exploit bugs for unfair advantage;
- Reverse engineer, decompile, copy, modify, or create derivative works of the Service except to the extent this restriction is prohibited by law;
- Submit malware, or interfere with, overburden, or disrupt the Service or its servers and networks;
- Use the Service to develop a competing product or to train a machine-learning model; or
- Use the Service in violation of any applicable law, regulation, or third-party right.
We may investigate suspected violations and may remove content or restrict, suspend, or terminate accounts that we reasonably believe violate these Terms.
To operate and protect the Service, we collect and log your IP address along with other technical information (see our Privacy Policy). To enforce these Terms and prevent fraud, abuse, or evasion of a ban, we may block or restrict access from specific accounts, IP addresses, or networks.
8. Classes, Messaging & Community Conduct
Some classes offer messaging features, including class chat and direct messages. Direct messages are available between members of the same class — including between students — and between students and their teacher. Where enabled, messaging is intended for educational communication only. Supervised accounts for children under 13 cannot use class chat or direct messages.
- Teachers control whether class chat is enabled for their class, can choose whether students may send them direct messages, and can remove students from their class.
- Class chat messages are visible to your teacher and to the other members of the class. Direct messages are visible only to the participants in the conversation; teachers cannot read direct messages between students.
- Messaging is filtered by an automated profanity filter. Violations trigger automatic warnings and escalating temporary suspensions of your messaging privileges. If you believe a suspension was applied in error, contact support@zykostudy.com.
- Chat and message history is limited: only a recent window of messages is kept per class chat and per conversation, and older messages are automatically deleted. You can delete a direct message you sent within a short period after sending it.
- Do not share personal contact information or arrange off-platform contact through messaging, and do not use messaging to harass or harm others.
- You can report a direct-message conversation from inside the conversation (or by contacting support@zykostudy.com). When a conversation is reported, we preserve a copy of its recent messages for review even if messages are later deleted, and we may act on what we find, including restricting accounts.
- Live races: signed-in users can host a live race and invite others to join with a race code. Anyone signed in who has the code can join, so only share a race code with people you want in your lobby. Your display name and race performance are visible to everyone in the race for its duration. Supervised accounts for children under 13 cannot host or join live races.
ZykoStudy does not monitor all communications and does not guarantee that objectionable content will be prevented, detected, or removed. Automated filtering is limited and will not catch everything. We may review reported content and act on reports and violations at our discretion. Parents, guardians, and schools should supervise minors’ use of messaging features.
9. Your Content & the Rights You Grant Us
“Your Content” means anything you submit, upload, create, or generate through the Service, including question sets, uploaded documents and images, free-response answers and other submissions, profile information, profile photos, and messages.
You retain ownership of Your Content. You grant ZykoStudy a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, display, and transmit Your Content as needed to operate, provide, secure, and improve the Service (for example, to store a question set, deliver an assignment to your students, grade a free-response answer, or generate study content at your request). This license ends when Your Content is deleted from the Service, except for residual copies retained as described in our Privacy Policy or required by law.
Publishing to the public library
If you choose to publish a question set to the ZykoStudy public library, you additionally grant ZykoStudy the right to display, distribute, and make it available to all users of the Service, and you grant other users a license to view and play it within the Service. Your author credit (your display name) is shown with published sets, and other users may rate and report them. You can unpublish a set at any time, and your sets are removed when your account is deleted, but copies of content that was public may persist in limited backups for a period as described in our Privacy Policy. Only publish content you have the right to share publicly. In particular, question sets generated from materials you do not own or have permission to share publicly (for example, a textbook chapter, a publisher’s study guide, or someone else’s slides) may be used privately for your own study but must not be published to the public library.
Importing videos
Some features let you import a link to an online video (for example, a YouTube video) so the Service can retrieve or generate a transcript and create study questions from it. Import only videos you have the right to use for your personal study, and do not publish question sets generated from someone else’s video to the public library without permission. Video platforms have their own terms that may apply to your use of their content, and we may limit, change, or disable video import at any time.
You represent and warrant that, for the materials you yourself upload or submit and for any content you choose to publish or share, you have the necessary rights to do so and to grant these licenses, and that it does not infringe any third party’s intellectual property, privacy, or other rights or violate any law. You are responsible for Your Content. We do not endorse and are not responsible for user content, and we may remove content that we reasonably believe violates these Terms or any law.
10. Feedback
If you send us ideas, suggestions, or other feedback about the Service, you agree that we may use it without restriction or compensation to you, and you grant us a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate it into the Service. Feedback does not include Your Content.
11. Copyright & Takedown Requests
We respect intellectual property rights and expect users to do the same. Do not upload or share materials you do not have the right to use. Our designated agent for copyright notices under 17 U.S.C. §512, registered with the U.S. Copyright Office, is: Kamran Yashouafar, ZykoStudy Copyright Agent, 16255 Ventura Blvd., Suite 400, Encino, CA 91436, email support@zykostudy.com (subject line “DMCA Notice”). If you believe content on the Service infringes your copyright, send a notice to our Copyright Agent with: identification of the work; the location (URL) of the allegedly infringing content; your contact information; a statement of good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; a statement, under penalty of perjury, that your notice is accurate and that you are the rights holder or authorized to act on the holder’s behalf; and your physical or electronic signature. We will remove or disable access to content identified in a valid notice expeditiously.
If your content was removed and you believe the removal was a mistake or misidentification, you may send our Copyright Agent a counter-notice with: your name, address, telephone number, and email; identification of the removed content and where it appeared; a statement under penalty of perjury of your good-faith belief that the removal was a mistake or misidentification; a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which ZykoStudy may be found) and that you will accept service of process from the person who filed the original notice or their agent; and your physical or electronic signature. Unless the original claimant files a court action, we may restore the removed content in 10 to 14 business days after receiving a valid counter-notice.
We maintain a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers.
12. AI Features & Important Disclaimer
The Service uses artificial intelligence to power features such as the AI tutor and explanations (including follow-up questions you type), automatic question generation from your materials (documents, images, and video transcripts), free-response grading assistance, study-session summaries and practice recommendations, and diagram generation. To provide these features, content you submit may be sent to third-party AI providers that process it on our behalf, as described in our Privacy Policy. We recommend avoiding unnecessary personal information about yourself or others in the text, files, and images you submit to AI features; content a feature requires (such as a free-response answer you submit for grading) is processed as described in our Privacy Policy.
AI-generated content can be inaccurate, incomplete, or misleading, and may produce different results for the same input. AI features are provided to assist learning and instruction only.
- Do not rely on AI-generated content as a substitute for professional, academic, medical, legal, financial, or other advice.
- Always review and verify AI-generated questions, answers, explanations, grades, and other outputs before relying on them, especially for grades, exams, or anything important.
- For free-response questions where AI grading is enabled, an AI-suggested grade is applied and shown to the student automatically when they submit. Teachers can review and change AI-graded results afterward and should do so before relying on them or recording grades outside the Service.
- We do not guarantee any particular educational outcome, score, or result from use of the Service.
Usage of AI features may be subject to limits, and we may meter, cap, throttle, or change AI features at any time. Content that is reported by users may be automatically reviewed with AI, which can result in content being hidden or removed and in temporary account-level enforcement. Automated enforcement actions are temporary pending human review. If you believe an automated action was applied in error, contact support@zykostudy.com and we will have a person review it, generally within 5 business days.
AI outputs
As between you and ZykoStudy, we assign to you our right, title, and interest (if any) in the AI outputs generated at your request, and they are treated as Your Content. Because of how AI works, outputs may not be unique to you (similar or identical outputs may be generated for other users), and outputs generated from materials you provide may reflect or reproduce third-party material from those inputs. You are responsible for reviewing outputs, and for making sure you have the necessary rights, before you publish or share them.
13. XP, Badges & Virtual Items
The Service includes virtual rewards such as XP, badges, avatars, game unlocks, and consumable tokens (for example, hints, skips, and shields) (“Virtual Items”). Virtual Items are earned through gameplay and activity within the Service, and some (such as game unlocks and consumable token packs) are acquired by spending XP you have earned.
- Virtual Items are not real money, have no cash or monetary value, and cannot be redeemed, exchanged, sold, transferred, or withdrawn for money or anything of value outside the Service.
- Virtual Items are licensed to you for use within the Service only; you do not own them.
- We may adjust, expire, revoke, or reset Virtual Items, balances, prices, and availability at any time, including to address bugs, abuse, or service changes.
- Virtual Items are non-refundable, and any balance is forfeited if your account is terminated for a violation of these Terms or the Service is discontinued.
Virtual Items cannot currently be purchased with real money, and this section applies only to rewards earned through play. It does not apply to anything you purchase for money: paid-plan entitlements are governed by the “Paid Plans & Billing” section above and by the terms presented at checkout.
14. Early Access & Beta Features
The Service, or individual features within it, may be offered in an early-access, beta, or experimental form. Beta features are provided for evaluation, may be less reliable than other features, may change or be removed without notice, and may involve additional usage limits. Your use of beta features is at your own discretion and subject to these Terms, including the disclaimers below.
15. Intellectual Property & Trademarks
The Service and all of its content and materials (including games, software, text, graphics, designs, logos, trademarks, the look and feel, and the underlying technology) are owned by ZykoStudy or its licensors and are protected by intellectual property and other laws. Except for the limited license granted to you in these Terms, we reserve all rights. You may not copy, reproduce, distribute, publicly display, modify, or create derivative works from the Service or use our names, logos, or trademarks without our prior written permission.
AP® and Advanced Placement® are trademarks registered by the College Board, and SAT® is a trademark registered by the College Board. ZykoStudy is not affiliated with, authorized, sponsored, endorsed by, or otherwise connected to the College Board, and the College Board does not sponsor, endorse, or review our content. Any reference to AP®, SAT®, or College Board materials is for identification and descriptive purposes only. Other product, service, and company names mentioned on the Service are the trademarks of their respective owners, and our reference to them does not imply any affiliation with or endorsement by them.
16. Third-Party Services & Links
The Service relies on, and may link to or integrate with, third-party services and content (for example, sign-in providers, AI providers, our payment processor Stripe, hosting and email providers, and educational resources such as embedded videos). We do not control and are not responsible for third-party services or content, and your use of them may be governed by their own terms and privacy policies. Links and integrations do not imply our endorsement.
17. Privacy
Our Privacy Policy explains what information we collect, how we use and share it, and the choices and rights available to you, parents/guardians, and schools. By using the Service, you acknowledge that information will be handled as described in the Privacy Policy.
18. Disclaimers
THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, ZYKOSTUDY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, timely, error-free, or free of harmful components, or that any content (including AI-generated content and user-published content) will be accurate, reliable, or appropriate. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
19. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ZYKOSTUDY AND ITS OWNERS, OPERATORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS YOU PAID TO ZYKOSTUDY FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). THE EXCLUSIONS AND LIMITATIONS IN THIS SECTION APPLY EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE, AND EACH PROVISION OF THIS SECTION IS SEVERABLE. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and nothing in these Terms limits liability that cannot be limited by law.
20. Indemnification
This section does not apply to you if you are under 18. If you are 18 or older (including teachers, parents, and schools accepting these Terms), you agree, to the extent permitted by law, to indemnify and hold harmless ZykoStudy and its owners and operators from and against third-party claims, liabilities, damages, losses, and expenses (including reasonable legal fees) to the extent they arise out of your unlawful conduct, your infringement of a third party’s rights, or content you upload or publish in violation of these Terms.
21. Suspension & Termination
You may stop using the Service and delete your account at any time through your profile settings or by contacting support. We may suspend or terminate your access to the Service or specific features (including messaging privileges, which may be suspended automatically by our moderation systems), with or without notice, if we reasonably believe you have violated these Terms or the law, to protect the Service or other users, or if the Service is discontinued. We may also terminate accounts that have been inactive (no sign-in) for 12 or more consecutive months, but only after emailing the address on the account at least 30 days in advance. Anything you purchased for money is handled under the “Paid Plans & Billing” section, not forfeited under this one. If you believe an enforcement action was taken in error, contact support@zykostudy.com and a person will review it.
Upon termination, your license to use the Service ends. Sections that by their nature should survive (including ownership, Your Content licenses for residual copies, feedback, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law) will survive. Deletion and handling of your data after termination are described in our Privacy Policy.
22. Changes to the Service or These Terms
We may modify these Terms from time to time. If we make material changes, we will notify you in advance by email to the address on your account (typically also with a prominent in-app notice), and material changes will take effect no earlier than 15 days after notice, except where a change is needed sooner to comply with law or address security. For material changes we will also ask you to re-accept the updated Terms in the app. Non-material changes (like clarifications or formatting) take effect when posted with an updated “Effective Date.” If you do not agree to updated Terms, stop using the Service and delete your account.
23. Governing Law & Dispute Resolution
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
Before filing any formal claim, you agree to first contact us at support@zykostudy.com and attempt in good faith to resolve the dispute informally for at least 30 days. If the dispute is not resolved, you and ZykoStudy agree that it will be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts, except where applicable law gives a consumer or minor the right to bring a claim in another forum.
To the fullest extent permitted by law: (a) any claim relating to the Service must be filed within one (1) year after the claim arose, or it is permanently barred; and (b) you and ZykoStudy may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. These limitations do not apply where prohibited by law. For example, the one-year period is extended where applicable law pauses (tolls) limitation periods, including for minors. Nothing in these Terms waives rights that cannot be waived under applicable law.
If you are a consumer in the European Economic Area, the United Kingdom, or another jurisdiction whose laws give you mandatory protections, nothing in these Terms deprives you of those protections: you keep the rights local law guarantees you (including any legal guarantee of conformity and non-waivable remedies), the warranty disclaimers and limitations above apply only to the extent your local law allows, and you may bring proceedings in the courts of your place of residence where your local law gives you that right.
24. Content Removal for Users Under 18
If you are a registered user under 18 (including California minors exercising rights under California Business & Professions Code §22581), you may remove, or request removal of, content you posted to the Service. Any registered user may do the same.
- Question sets: unpublish or delete your sets at any time from My Creations.
- Direct messages: you can delete a message you sent within a short period after sending it.
- Class chat messages and anything else you cannot remove yourself: email support@zykostudy.com with a link to or description of the content, and we will remove it or anonymize your authorship.
Please note that removal does not ensure complete or comprehensive removal of the content: copies may persist in limited backups for a period, content that someone else copied, saved, or re-posted may remain, and we may retain content where the law requires or allows.
25. General
- Entire Agreement. These Terms and the Privacy Policy are the entire agreement between you and ZykoStudy regarding the Service and supersede any prior agreements on that subject, except that a separate written agreement between ZykoStudy and your school or district controls to the extent it conflicts with these Terms.
- Severability. If any provision is found unenforceable, the remaining provisions remain in full force and effect.
- No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- No Third-Party Beneficiaries. These Terms do not create any rights for any person who is not a party to them, except as expressly stated.
- Force Majeure. We are not liable for failures or delays caused by events beyond our reasonable control.
- California Notice. The Service is provided by ZykoStudy, 16255 Ventura Blvd., Suite 400, Encino, CA 91436, which you can reach at support@zykostudy.com or through our support page. The core Service is free of charge. Optional paid subscription plans are Plus at US$7.99 per month and Premium at US$10.99 per month, billed monthly until cancelled (see “Paid Plans & Billing”). Under California Civil Code §1789.3, California users are entitled to know that they may file grievances and complaints with the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N-112, Sacramento, CA 95834, or by phone at (800) 952-5210.
- Headings. Section titles are for convenience only and do not affect interpretation.
